This Privacy Policy defines “Personal Information” as any information or opinion about an individual that can identify them or make them reasonably identifiable, regardless of whether it is accurate or recorded physically. It is important to note that we may collect Personal
Information from various sources, including resumes, our website, job advertising sites, social media, professional networking sites, offline events, and printed materials, and combine it for analysis.

Your Personal Information and how we collect it

Candidates

We obtain your Personal Information from you and other sources. This includes when you apply for a job through a job board, our website, or Social Media platforms like LinkedIn, Facebook, Instagram and Twitter, additionally when you provide your details during a promotional, networking or training event.

When you engage with us to provide employment placement services by applying for a job or submitting your details to our company, you become a Candidate of Able Recruitment. During the Candidate Registration process, we collect your Personal Information from you, your CV, employment referees, and online tests/checks you may perform at our request.

We shall seek your expressed consent via an Engagement Agreement if we engage with you via third-party online job boards or Social Media platforms such as LinkedIn, Facebook, Instagram and Twitter that reasonably indicate that you are looking for employment or accept a Social Media connection between you and us. You shall become a Candidate of Able Recruitment when we receive your expressed consent.

When you apply for a position, we may disclose your personal details to Clients recruiting for roles that align with your credentials. These employers may require further information from you concerning their specific job openings.

Your Personal Information will be securely stored in our systems.

The categories of Personal Information we may collect include:

  • your identity (your full name, previous names, evidence of change of name, gender and date of birth);
  • evidence of your right to work in Australia which may include a photograph, nationality, place of birth, birth certificate, passport information, driving licence, etc. (per Home Affairs requirements);
  • contact details, including your email, home address and phone numbers so that we can contact you by email and text message;
  • bank account and tax file number (so we can make payments to you and account for tax if you are working as a temporary or contingent worker supplied through Able Recruitment);
  • superannuation details if you are working as a temporary or contingent worker supplied through Able Recruitment;
  • your job search criteria, preferences and expectations;
  • your qualifications, skills, experience and training;
  • current and desired remuneration/pay rate and other benefits;
  • educational history;
  • employment history;
  • references;
  • other information that you, your referees or our clients provide to us, including personal feedback and notes of our interactions with you and others about your suitability for work with us or through us;
  • aptitude and psychological assessment results;
  • the results of background checks;
  • other information contained in your CV or that you choose to provide to us;
  • technical data, including internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website. We may also receive technical data about you if you visit other websites employing our cookies.
  • profile data, including your username and password used on our website, your interests, preferences, feedback and customer survey responses;
  • usage data, including information about how you use our website and services;
  • marketing and communications data, including your marketing and communication preferences;

Our team will send you emails containing job opportunities that match your search criteria and preferences to assist you with employment placement services. We may also send you job alerts that our consultants think you may find interesting. If you have signed up for job alerts on our website, you will receive emails that match your job search criteria and preferences.

Applicants for Employed Roles

If you are applying for a role as our employee, we will collect Personal Information via your CV, referees, professional and educational organisations and other sources. We will process your Personal Information to administer the application, manage the internal hiring process and assess your suitability. We will store your Personal Information securely in our confidential online database. Your Personal Information cannot be viewed or accessed by anyone except for employees of Able Recruitment and other staff if they are connected to the hiring process, such as interviewing, assessing your suitability for the role you have applied for and communicating with you. We do not share our database with companies not associated with Able Recruitment, and we will take steps to ensure that your Personal Information is adequately protected, secure and kept confidential. Suppose we engage a third party to provide pre-employment screening services or testing. In that case, we will ensure that access is limited to the Personal Information compatible with those services and that the service provider is contractually obliged to comply with applicable data privacy laws and confidentiality and provide adequate safeguards to keep your Personal Information secure until it is deleted or anonymised.

By applying for employment with us, you consent to us processing your Personal Information for these purposes. You have the right to withdraw your consent at any time. If you withdraw your consent, we cannot continue with your application.

If your employment application is unsuccessful, we will retain your Personal Information on our database for a reasonable period to evidence that we have conducted the recruitment process fairly and transparently and have not discriminated against applicants on prohibited grounds. Occasionally, we will contact you regarding other opportunities that may interest you. When requested by you, we will remove all the information collected during the recruitment process except the information we are required to keep in line with the relevant legislation.

Sensitive Information

We understand that your privacy is important to you, so we want to assure you that we will only process information related to any unspent criminal convictions, court proceedings, or pending proceedings if it is necessary for our clients and is in accordance with the law. If our clients require us to assess your suitability for a role within their organisation, we may be required to disclose any unspent convictions and criminal proceedings. However, we will always obtain your consent before collecting and supplying any sensitive information.

Our Clients and Suppliers

As we engage with clients, suppliers, and potential clients or suppliers, we understand that we must collect and handle information about individuals within your organisation. This will involve adding the person’s name and business email address to our database as your organisation’s designated point of contact, along with other relevant business contact information. Typically, the personal information we process about a corporate contact is limited to their name, which is necessary to communicate with your organisation about our services or to authorise time sheets or payments for goods and services provided by suppliers.

Suppose the corporate point of contact is also a registered candidate. In that case, we may collect additional personal information for the purposes of work finding and other related activities, as outlined in our policy. We may receive this information directly from the individual, or it may be provided to us by a member of the HR or procurement department, an existing business contact, or a candidate we have placed within the organisation.

We may also obtain this information from publicly available sources, such as websites or social media platforms. We may reach out to corporate points of contact via email for business-to-business marketing purposes. However, we fully understand and respect an individual’s right to request that we stop sending such emails to their business email address, and we are happy to comply with such requests promptly upon receipt.

Referees

Regarding referees, we gather the necessary information to properly assess a candidate’s appropriateness for employment with us or as part of our employment placement services.

The primary types of information we require from referees include your contact information, including your:

  • address and phone numbers
  • details regarding your job title and responsibilities
  • your professional opinions regarding a candidate’s qualifications and suitability for employment

We will also disclose your Personal Information to our Clients concerning their job vacancies.

We may use your Personal Information for other valid business purposes, such as generating statistics, evaluating the success of our marketing campaigns, monitoring website traffic, and fulfilling contractual, legal, and regulatory obligations.

If you provide us with information about third parties, we will assume that you have obtained their permission for us to collect, process, and transfer their Personal Information, just as we would with yours.

Our success relies on efficiently matching candidates with clients’ vacant positions. Our recruitment consultants review candidates based on their expertise, knowledge of the job market, understanding of the client’s business and role requirements, candidate discussions, and other relevant criteria. Clients’ hiring personnel determine which candidates to interview and ultimately select for the job.

Disclosing your Personal Information to Third Parties

To the extent necessary or appropriate and without notifying you, Able Recruitment may disclose your Personal Information to external third parties (who are not members of Able Recruitment) in the following circumstances:

  • to third parties we employ to perform business functions and services on our behalf. Examples of service providers include: providing payroll services to enable us to pay our employees and temporary workers who work on client premises; background screening and verification services; data storage facilities in the Cloud; hosting our Web servers; managing job posting applications via our third-party provider; analysing data and producing statistics and legal, accounting, audit and other professional services.
  • to government agencies, including the Australian Tax Office, law enforcement agencies; regulatory and supervisory authorities; credit reference agencies; and third parties performing sanctions and terrorism checks;
  • to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to: (a) comply with the law requiring such disclosure; (b) protect the rights or property of Able Recruitment; (c) prevent a crime, protect national security or for fraud detection or prevention; or (d) protect the personal safety of individuals using our website or members of the public.
  • to third parties to whom we may sell, transfer, or merge parts of our business or assets. Alternatively, we may seek to acquire other companies or merge with them; and
  • to third-party IT consultants carrying out testing and development work on our IT systems, other service providers (including providers of relevant IT solutions) whom we may appoint as data processors and who may be based outside of Australia where your data may be stored.
