Privacy Collection Notification

Able Recruitment ABN 94 766 804 206 (“we”, “us”, “our”, or “Able Recruitment”) will need to collect personal information about you, your work performance, work experience and qualifications, aptitude test results and other information concerning your possible employment placements.

When you sign up with us or apply for a job, we collect your personal information. This includes screening and assessing your candidacy and receiving performance reports from your employers. We do not collect personally identifying information if you only browse our website. However, we may collect data about your website visit.

Who will be collecting your personal and sensitive information

We will need to collect your personal information to provide employment placement services.

Able Recruitment will be responsible for safeguarding this information. Please note that some of your personal details may be stored on portable devices such as laptops and mobile phones and in diaries maintained by our staff members. We may also use cloud-based services, including HRM platforms, to store your information securely.

Personal information about you that we collect from others

We obtain your personal information from various sources, such as referees, former employers, professional registration authorities, or educational institutions. This information helps us assess your suitability for a position we may offer.

In certain circumstances, if we believe that your presence in a position may pose a risk to your safety or the safety of others for whom we are responsible, we may collect relevant personal information, including health information, to manage that risk.

We may also gather information about your work performance from the employers where we placed you. This information allows us to fulfil our post-placement obligations, including managing any candidate replacement guarantee we may need to honour.

Legal requirements for personal information

When applying for certain positions, we may be legally required to collect specific information from you. This includes criminal history and proof of your right to work. These laws may include taxation, immigration, employment agencies, national security, professional or trade registration, labour hire licensing, public health, and protection for specific groups such as children or older adults.

The following Australian laws are applicable concerning the employment placement service that we provide:

  1. Fair Trading Act 1987 (NSW)
  2. Australian Consumer Law
  3. Migration Act 1958 (Cth) and Migration Regulations 1994 (Cth)
  4. The Fair Work Act 2009

There may be cases where our duties require us to obtain and disclose certain types of personal information relevant to specific jobs. When requesting information of this type, we will tell you whether the information supply is mandatory or voluntary.

If you do not give us all or part of the information we need

  • we may be limited in our ability to locate suitable work for you;
  • we may be limited in our ability to place you in work;
  • we might decline to represent you in your search for work or put you forward for particular positions.
  • Your personal information will be used in connection with the following:
  • verification of your identity and right to work in Australia;
  • our assessment of your suitability for registration with us;
  • the necessary validation (including from appropriate third-party sources) of your resume, C.V., nominated references, or stated qualifications, experience, training or abilities. Where we require third-party validation, we will tell you how we propose to obtain it;
  • your actual or possible work placement;
  • your performance appraisals;
  • any test or assessment (including medical tests and assessments) that you might be required to undergo;
  • any criminal check that may be necessary for the employer or the type of work being or proposed to be performed
  • our assessment of your ongoing performance and prospects;
  • our identification of your training needs;
  • suggestions we may make to you, whilst you remain registered with us, for further training in connection with work of the type that you are seeking through us;
  • any workplace rehabilitation in which you and we are involved;
  • our management of any complaint, investigation or inquiry in which you are involved;
  • any insurance claim or proposal that requires disclosure of your personal or sensitive information;
  • any reference that we may give concerning your work;
  • our statutory compliance obligations;
  • payroll functions;
  • determining what (if any) fees may be payable by our clients in respect of your actual or potential work placements;
  • our migration lawyers, should you require a valid visa to work in Australia;
  • job alerts relating to your field of expertise; please note these alerts can be stopped at any time when requested;
  • to keep in contact with you about roles we have placed you in or to request updated information from you.

Your personal information may be disclosed to:

  • potential and actual employers and clients of Able Recruitment;
  • referees;
  • a person who seeks a reference about you;
  • our insurers;
  • a professional association or registration body that has a proper interest in the disclosure of your personal and sensitive information;
  • a Worker’s Compensation body;
  • our contractors and suppliers – e.g. our payroll services providers, I.T. contractors, internet service suppliers and database designers, some of whom may be offshore;
  • a parent, guardian, holder of an enduring power of attorney (or like authority) or next of kin whom we may contact in any case in which consent is required, or notification is to be given and where it is not practicable to obtain it from or give it directly to you;
  • any person with a lawful entitlement to obtain the information;
  • Government departments and bodies if requested and required by law.
Background Checking

If we need to perform a background check with organisations based overseas, we may need to share some of your personal information with recipients outside the country. For instance, if you have previously worked with an employer located overseas, we may have to tell you your name, identifying details, and your work with your former employer to facilitate appropriate reference verification.

In those circumstances, the countries where the overseas recipient would likely disclose your personal information are those where the organisation is based.

Electronic Transactions

We conduct transactions electronically, in hard copy, and by face-to-face measures. You must understand that there are risks associated with using electronic technologies and the internet, and you should take all appropriate steps to protect your personal information.
